I, the undersigned, hereby accept to be bound by the terms and conditions as stated herein, and furthermore acknowledge that my stay at Finch Hattons luxury tented camp, (hereinafter referred to as FHLTC or “the camp”) and my use of facilities is at my own risk, and I voluntarily choose to accept all risks related thereto. I hereby acknowledge that I am aware and accept the inherent risks involved in safari travel, including but not limited to illness, tropical disease, injury, disability, accident, death, theft, loss, and damage of personal property, which may be caused by the negligence of others, forces of nature, and other causes known or unknown. I hereby voluntarily indemnify and hold harmless to the fullest extent permitted by law, FHLTC, future hotels, as well as their associated companies and their directors, ambassadors, employees, and agents against all claims of whatever nature arising from all and any loss and/or injury (fatal or otherwise) sustained by me, any minor under my care, or any of my accompanied guests; as well as any dependency claim(s) howsoever caused and howsoever arising and accept that any liability whatsoever and howsoever arising to FHLTC for any loss or damage of whatever nature shall be limited to the price of my booking. I undertake to be vigilant for and obey all cautionary notices and all instructions given to me at any stage by any guide or other officer or employee of FHLTC whilst in the camp or national park and consent to adhere to all FHLTC policies as well as emergency measures that FHLTC may need to undertake during my stay, including emergency treatment for myself and any minor under my care. I confirm that I am responsible for any minors accompanying me, whether or not in the company of a guide or staff of FHLCT, and hereby consent to such minor’s participation in activities at FHLCT. The terms and conditions as stated herein shall be governed by the laws of the Republic of Kenya.
